On December 15, 2008, the Honorable Louis L. Stanton, a Federal Judge in the United States District Court for the Southern District of New York, appointed Irving Picard as Trustee for the liquidation of Bernard L. Madoff Investments Securities LLC ("BMIS") pursuant to the Securities Investor Protection Act ("SIPA")

Bernie Madoff founded the firm in 1960 and has been a prominent member of the securities industry throughout his career. Madoff served as vice chairman of the NASD, a member of its board of governors, and chairman of its New York region. He was also a member of NASDAQ Stock Market's board of governors and its executive committee and served as chairman of its trading committee.

According to regulatory filings, Madoff Investment Securities had more than $17 billion in assets under management as of the beginning of 2008.

On March 10, 2009, a Criminal Information was filed in Manhattan federal court charging Bernard L. Madoff with eleven felony charges including securities fraud, investment adviser fraud, mail fraud, wire fraud, three counts of money laundering, false statements, perjury, false filings with the United States Securities and Exchange Commission ("SEC"), and theft from an employee benefit plan. There is no plea agreement between the Government and the defendant.

On March 12, 2009, Madoff pleaded guilty to all eleven counts in the Information. Madoff faces a statutory maximum sentence of 150 years’ incarceration.Madoff is also subject to mandatory restitution and faces fines up to twice the gross gain or loss derived from the offenses.
